PROCESSING BASED ON LAW AND CONTRACTUAL RELATIONSHIP*

In addition, the provider collects and processes (uses) your personal data for the following purposes, provided you give your consent:

CONTRACTUAL PROCESSING OF PERSONAL DATA*
As an individual, you are aware and agree that the provider can also delegate individual tasks related to your data to other people (processors). Processors may only process Confidential Data on behalf of the Provider, within the scope of the Provider's authorization (in a written contract or other legal act) and in accordance with the purposes defined in this Privacy Policy.
Processors with whom the provider works are:

STORAGE OF PERSONAL DATA*
The provider only stores your personal data for as long as is necessary to fulfill the purpose for which the personal data was collected and further processed. The provider stores the personal data that the provider processes on a legal basis for the period prescribed by law. The personal data that the provider processes for the purpose of carrying out a contractual relationship with a natural person will be stored by the provider for the period necessary to fulfill the contract and for a further 5 years after its termination, except in cases where there are disputes between you and the provider regarding the contract; In such a case, the provider will store the data for a period of 5 years from the legality of the court or arbitration decision or settlement or, if there is no legal dispute, 5 years from the date of the peaceful resolution of the dispute.
The provider will permanently store the personal data that the provider processes on the basis of the individual's personal consent or legitimate interest until such consent is revoked by the individual and requests to stop processing. The provider only deletes such data before deletion if the purpose of processing personal data has already been achieved or if this is required by law.
After the retention period has expired, the person responsible effectively and permanently deletes the personal data so that it can no longer be assigned to a specific person.
FREEDOM OF CHOICE*
You control the information you provide about yourself. If you do not share your data with the provider, you will not be able to access some parts or functions of the website. Right to withdraw consent: If you as an individual have consented to the processing of your personal data (for one or more specific purposes), you have the right to withdraw that consent at any time, without affecting the lawfulness of the data processing carried out based on the consent before its withdrawal. Consent can be revoked by sending a written statement to info@produktna-fotografija.si. Withdrawal of consent to the processing of personal data does not have any negative consequences or sanctions for the individual. However, it is possible that after withdrawing consent to the processing of personal data, the controller will no longer be able to provide one or more of its services to a person if these are services that cannot be provided without personal data.
The right of access to personal data: As an individual, you have the right to obtain confirmation from the provider (personal data controller) as to whether personal data relating to you are being processed and, if so, access to personal data and certain information (on the purposes of the processing, types of personal data, users, retention periods or criteria for setting time limits, the existence of a right to rectification or deletion of data, the right to restriction and objection to processing and the Right to complain to a supervisory authority, about the source). Data, if the data was not collected from you, about the existence of automated decision-making including the creation of profiles, the reasons for this as well as the meaning and consequences of this processing for you as well as further information in accordance with Art. 15 GDPR).
Right to rectification of personal data: As an individual, you have the right to immediately request that the provider correct inaccurate personal data concerning you. As a natural person, you have the right to have incomplete data completed, including the transmission of a supplementary statement, taking into account the purposes of the processing.
The right to deletion of personal data: As an individual, you have the right to have the provider delete personal data about you without delay, and the provider must delete the data without delay if one of the following reasons applies: the data is no longer necessary for the purposes for which it was collected and otherwise processed; if you withdraw your consent and there is no other legal basis for the processing; if you object to the processing and there are no overriding legal grounds for the processing; the data was processed unlawfully; the data must be deleted in order to comply with legal obligations under EU law or the law of the Member State applicable to the provider; the data was collected in the context of information society services.
However, as an individual, you do not have the right to have data deleted in certain cases referred to in Article 17(3) of the GDPR.
Right to restriction of processing: As a natural person, you have the right to request that the provider restrict processing in one of the following cases: if you dispute the accuracy of the data for a period enabling the provider to verify the accuracy of the data; the processing is unlawful and you object to the deletion of the data and instead demand a restriction of use; the provider no longer needs the data for the purposes of processing, but you need it to assert, exercise and defend legal claims; You have objected to the processing until it is determined whether the provider's legitimate reasons override your reasons.
Right to data portability: As an individual, you have the right to receive the personal data concerning you that you have provided to the provider in a structured, commonly used and machine-readable format and you have the right to transmit this data to another controller without hindrance from the provider to whom the personal data was provided, if: the processing is based on consent or a contract and the processing is carried out by automated means. As an individual, when exercising the aforementioned right to data portability, you have the right to have your personal data transferred directly from one operator (provider) to another, provided this is technically feasible.
Right to object to processing: As a natural person, you have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller (Art. 6 para. 1 lit. e GDPR) or which is necessary for the purposes of the legitimate interests pursued by the controller or by a third party (Art. 6 para. 1 lit. f GDPR), including profiling based on those processing. The controller will no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of establishing, exercising or defending legal claims. Where personal data are processed for marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing. If a person objects to processing for direct marketing purposes, the data will no longer be processed for these purposes. When data is processed for scientific or historical research purposes or for statistical purposes, the data subject has the right to object, on grounds relating to their particular situation, to the processing of data concerning them, unless the processing is necessary for the performance of a task carried out in the public interest.
The right to lodge a complaint with a supervisory authority: Without prejudice to any other (administrative or other) remedy, you as an individual have the right to lodge a complaint with a supervisory authority, in particular in the country where you have your habitual residence, where your place of work is located or where the alleged infringement took place (in Slovenia, this is the Data Protection Commissioner), if you believe that the processing of personal data relating to you infringes the rules on the protection of personal data.
Without prejudice to other (administrative or extrajudicial) remedies, you as an individual have the right to an effective legal remedy against the legally binding decision of the supervisory authority in this regard, even if the supervisory authority does not consider your complaint or does not notify you within three months of the progress of the case or the decision on the appeal. Proceedings against the supervisory authority are subject to the jurisdiction of the courts of the Member State in which the supervisory authority is located.

For the purpose of reliable identification when exercising rights relating to personal data, the administrator may request additional data from the individual and may refuse to take action only if they can demonstrate that they cannot reliably identify the individual. The data controller must respond to the individual's request, in which they exercise their rights relating to personal data, without undue delay and at the latest within one month of receiving the request.
In the event of a breach of personal data protection, the provider is obligated to report this to the competent supervisory authority, unless it can be assumed that the rights and freedoms of natural persons have not been jeopardized by the breach. If, at the time of the breach, there is suspicion that a criminal offense has been committed, the provider is obligated to inform the police and/or the competent public prosecutor's office about the breach. If the breach is one that could pose a serious risk to the rights and freedoms of individuals, the provider is obligated to report the breach without undue delay, or, if this is not possible, to inform the individuals to whom the personal data relates without undue delay. The notification to the individual must be intelligible and clear language.
